The Foody UK & Ireland will endeavour to ensure that the Site is accessible for 24 hours a day. However, The Foody UK & Ireland will not be liable if, for any reason, the Site is unavailable at any time or for any period. This includes server upgrades and other such essential maintenance.

The Foody UK & Ireland will have the right to suspend access to the Site temporarily or permanently and without notice.

The Foody UK & Ireland will not be liable for loss or damages arising in contract, tort or otherwise if the Site becomes unavailable or is suspended for any reason.

Information contained on the Site is provided for information purposes only and The Foody UK & Ireland uses reasonable endeavours to ensure that it is accurate at the date of publication. However, because of the nature of the Internet, there may be circumstances in which errors or omissions in the information may occur which are beyond the reasonable control of The Foody UK & Ireland. Consequently The Foody UK & Ireland will not be liable for loss or damages arising, in contract, tort or otherwise, directly or indirectly from the use of or reliance upon any information contained on the Site, unless the accuracy of the information has been checked with The Foody UK & Ireland before reliance is placed upon it.

Refund Policy for Listings

All standard and featured links are made to order and hence are exempt under The Consumer Protection Distance Selling Regulations 2000 from a seven day cooling off period after purchase.

Section 13.1.c of the aforementioned regulations states that:
Unless the parties have agreed otherwise, the consumer will not have the right to cancel the contract by giving notice of cancellation ... in respect of contracts.... for the supply of goods made to the consumers specifications or clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.

Of course, any submitted listings which are not added to the directory (The Foody UK & Ireland reserves the right to refuse any listing) with receive a full refund. In addition, The Foody UK & Ireland can provide refunds at any time and at our discretion due to other circumstances, for example if a mistake is made during ordering or if there is a technical problem which prevents the transaction completing correctly.

Applicable Law

As the Site is established by The Foody UK & Ireland in England, English Law shall govern its use at all times and in the event of a dispute, the relevant parties irrevocably submit to the exclusive jurisdiction of the English Courts. The Foody UK & Ireland also adheres to all European Union regulations governing its use.

Advertisement Terms

'The Advertiser' is the person, company or organisation in whose name advertising or paid for space is booked.

Any person, organisation or business agreeing to advertise with The Foody UK & Ireland will pay an agreed fee with payment due on receipt of invoice.
Failure to pay will result in the immediate removal of the Advertiser's listing or advertisement and all associated references.
Prices are guaranteed for the period stated.
Prices are confidential and may not be disclosed to any third party.
Unless otherwise set out in these Advertising Terms, the Advertiser will not be entitled to any refund, credit, lien or set-off of any kind from the time the relevant fee is paid to The Foody UK & Ireland.

Advertisers will be bound by any terms and conditions agreed at the time of contract or from time-to-time.
The Foody UK & Ireland reserves the right to remove any listing or advertisement if the advertiser is in breach of any terms so agreed.

The Advertiser indemnifies The Foody UK & Ireland its executives and employees against any claim whatsoever arising from the content of any advertising or graphic image or text content it supplies for publication on The Foody UK & Ireland web pages or in any email newsletters or circulars issued by The Foody UK & Ireland.

The Advertiser indemnifies The Foody UK & Ireland its executives and employees against any claims howsoever arising from errors or omissions within any advertising or paid for page or other page on the The Foody UK & Ireland website or in any email newsletters or circulars issued by The Foody UK & Ireland.

All advertisements and paid for space in relation to the advertising of products or services on the The Foody UK & Ireland website will be prepared from information and graphics supplied by the producer or copied from the producer's website as appropriate.
Any mistakes in textual, graphic or hyperlink content are the responsibility of The Advertiser, though amendments will be made upon request in a timely manner at no additional charge.
The Foody UK & Ireland may ask for additional information or graphics or pictures of specified technical quality or in specified formats.

Advertisements and paid for space will conform to The Foody UK & Ireland's format as best achieved from the information and materials supplied by the advertiser.
Whilst The Foody UK & Ireland will always endeavour to meet advertisers requirements, The Foody UK & Ireland retains all rights regarding design, layout and functionality of all website pages.
We reserve the right at any time to edit or alter the presentation of the Content.
We reserve the right at any time to alter the placement of any advertisement, as and when new product categories are added. or for any other technical reason, though we will always endeavour to notify The Advertiser.

The Foody UK & Ireland will undertake to update, change or amend any advertisement or paid for space at the advertisers request once per calendar month at no charge and will implement such changes or amendments in a timely manner, additional changes or amendments will be charged at our standard rate..

For the avoidance of doubt, the Advertising Services shall not include the tracking and logging of user transactions made involving the Website.

We try to ensure continuous availability of the site and all the services available on it but accept no responsibility for the consequences of interruptions or delays, however caused. We may, additionally, alter the design and specification of the site at any time.

Any advertisement or paid for page or other reference does not imply any endorsement by The Foody UK & Ireland its officers or employees of any product service or facility offered by that advertisement, page or reference.

The Advertiser warrants that:
(a) They will be responsible for obtaining and paying for all necessary licenses and consents for the display of any advertising or copyright material contained or the appearance of any person in his advertisement.
((b) No advertisement will be in breach of copyright or other rights or be defamatory of any third party.
((c) They will indemnify and keep indemnified the publisher against all claims, demands, proceedings, damages, costs, charges and expenses arising from breach of the above warranties or in any other way arising out of the publication of the advertisement or anything done as a result thereof.
